Got pushed by resident at work tore rotater cuff was out 4 weeks before MRI confirmed it was released 50% by emergency room doctor then by occupational wellness 50% work does not offer light duty now I need surgery can I collect 100% from initial date? It took 5 weeks to receive my first check!
You should request a hearing claiming you were totally disabled and awaiting surgery, and ask for the full rate. Even if they don't give you the full rate now, you should pick it all up retroactively at the time you have reached maximum medical improvement and are evaluated for schedule loss. I think you should get yourself a compensation attorney, I foresee many issues arising. If there are none in Franklinville there are some in Buffalo which is the closest large city to Franklinville. Check your county bar association referral panel, if they have no compensation attorneys call the Erie County Bar Association
This is merely a general response to a common inquiry and does not create an attorney client relationship. An attorney client relationship can only be established by a meeting with the writer or a member of his firm, and a written authorization to represent.
Dear Madam or Sir:
Mr. Fusco is correct. We assume you had already filed a C-3 claim form with the WCB and a copy to your Employer. If not, download the form asap from the WCB web site and fill it out. Make sure your doctors are sending in reports to the WCB and the Employer's Carrier.
As advised, ask for a Hearing.
If you need someone in the Buffalo area, try giving Gary Campbell a call; he is very knowledgeable.
The foregoing is based on the little information provided; additional facts may change the comments given.
