I got 2 dwi charges (1 in 2007, 1 in 2014) on my criminal record, but 3 dwis (1 in 2007, 1 in 2014, 1 in 2015) on my DVS record. I was never charged for my 3rd dwi (2015 dwi) but why is it showing on DVS? I was put on the interlock device program because on my DVS record it shows 3 dwis. I was on the program for almost 2 years and had 2 violations due to my dentist recommending listerine for my gums because it was swelling due to my root canal operation. I blew a .081 and .075 and now they want me to restart the whole program. I dont drink anymore and havent had a drink since my 3rd dwi. Can I fight the 3rd dwi case off my DVS record and get rid of the interlock? or am I stuck to restarting the whole program? Any help will be appreciated. Thanks..
Did your lawyer file a court challenge related to the driver's license revocation in 2015? It's called an implied consent challenge. If not, then you do have a three on your record.
Listerine isn't usually a defense. It contains alcohol just like alcoholic beverages do.

It’s likely a revocation of your driving privilege could be the key here. You should consult with an experienced criminal defense attorney in your area for help with this question.
The third offense is likely a license revocation elated to the DWI, which is civil in nature. If you did not file to contest the revocation, it is a third enhancement that impacts how and when you can reinstate your license.

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.
