If your criminal appeal gets approved and the appellate court chooses a new trial can the defendant withdraw the appeal or does the defendant HAVE to proceed with new trial? Basically when is the absolute last moment a defendant can back out of an appeal?
Why would you do that? It would be before the Court of Appeals rules. You don't have to have a new trial, you could enter a plea.
