Worked 4.5 hours on Christmas eve, did not work on Christmas day but was supposed to receive pay and called off on December 26th. I received my pay check and was not paid for Christmas (looked online I was not entitled to that pay since I was in "non-pay" status on the 26th) or Christmas eve. I worked on the clock a half day on Christmas eve. Legally I should be entitled to that pay regardless of what happened on the 26th correct? Does anyone know the statute or law I can find supporting information in so that I can turn it into my employer?
Employees don't generally have a legal right to be paid for holidays not worked. One exception is if they have a contract (whether through a union or otherwise) that states otherwise.
You say you were "supposed to receive pay" for Christmas day, but without knowing more, I cannot opine as to whether you were actually supposed to receive pay for that day. For example, if a company does have a "holiday pay" policy, often times it will require an employee to work the day before and the day after a holiday. If that was the case, your calling off on the 26th would make you ineligible for the Christmas day holiday pay.
