I was arrested for misdemeanor charges and ACS placed my children with my children's mother. Im not incarcerated and the children were not with me at the time of arrest and they have been receiving excellent care according to ACS, preventative service records and complying with all programs and services and testing negative for all tox screenings for months up until this point.
This is a two part question. If you are asking whether they CAN do it, the answer is that they did so obviously they can. However, if you are asking how to get them back, well for that you need to hire an attorney that will help you deal with both ACS as well as with the custody matter between you and the children's mother. Speak to an attorney immediately. Either use the Find a Lawyer tab on Avvo or speak to one of the attorneys who answered this question as our information is available on the site.
