owe attorney fees. I make 300.00 a month pymts. He has put a lien against me. I have 8 plus thousand dollars in a trust fund from the sell of my house . I live on ssd and a pension from my ex. Can the attorney take those monies out of my checking acct?
The answer will depend on the trust and how it is held. Usually a trust is not liable for the debts of the beneficiary, however if the trust formalities have been ignored the assets may be subject to creditor claims. If your bank account is attached see an attorney at once and properly fill out your exemption claims and file them.
