We are getting a divorce after 50 years of marriage. my husband couldn't stop cheeking. we are doing a no fault divorce. He has indicated he will not sign the papers. What are my options? I can't live with him he is abusive .
There are hopefully some much needed changes to the law regarding domestic violence in the works. You should contact an attorney and discuss your options regarding your particular situation. After discussing the details of your case with an attorney they might recommend that you file for divorce even if there has not been a "paper trail" of documentation showing prior abuse.
If he refuses to sign the paperwork needed for a "no fault" divorce, you will have to either sue him for a fault divorce if you can prove a fault ground such as adultery, habitual cruel and inhuman treatment, habitual drunkeness, habitual drug use, etc; or if you cannot prove a fault ground, you'll have to stay married.
