If you are an uber driver, and you push a drunk passenger from touching you while driving, is that assault?
Hello, this is not my situation, but for a friend. So my friend's dad is an uber driver and one day when he was driving a drunk passenger home, she suddenly started reaching towards his seat and was placing her hand near the steering wheel, so my friend's dad pushed her really hard. In the end, the dad finally drove her home and she apologized to the dad and everything about what happened, and she had no injuries from that moment. However, a few months later there was a report on the dad and she claimed that the dad sexually assaulted her and was trying to rape her, and there is no evidence on either side about this situation. The dad is a good uber because he has so many good ratings. Right now, the dad's TLC license is taken away and he can't work so he can't support his family that relies heavily on him. He even said that he did not report the lady because she apologized when leaving, but will the dad be punished if there is no clear evidence on either side?
