Bought a house (2002 in texas) when I was single. Met boyfriend in 2012 moved in 2014. Filed common law in 2015. We got married this year. Has not made any mortgage payment, and never asked him.
It should be your separate property but it will be your burden to prove it. A pre-nup would have gone a long way.
Knowledge is power. Hire a professional to listen to all of the facts and help you make informed decisions.
Since the house was bought many years before the marriage, it is your sole and separate property and your husband has no claim or stake in it.
The house appears to be your separate property based on inception of title in 2002 and your marriage in 2015. Your earnest money contract created rights in the property when you signed that. Your deed still precedes the marriage. I do not believe you have any problem unless there is any information not disclosed here.
