Child is three. Parent A consistently violates parenting plan but has primary residence checkbox. Parent B never violates parenting plan but lives far away due to stalking and harassment and ongoing DV behaviors from Parent A. Parent B tried to obtain DVPO but it got dismissed due to Parent A counter accusations and good attorney. Parent A is currently withholding child indefinitely after Parent B reported serious concerns over Parent A’s friends to DHS and they are investigating. Parent B was afraid to file emergency custody order per advice of Oregon family law attorney. Parent B is going to file enforcement of pt but is scared to ask for custody modification because of the complicated nature and limit s funds and can not risk losing child to Parent A forever. What should Parent B do if Parent A is mean and unreasonable with Parent B and child, but Parent B is a pacifist?
