Where there is a contract for services with a certain degree of expectation on the progress and diligence of those services.... then not only are the expectations not met, but other factors like rights violations and negligent conduct occur- who (after unsuccessfully following grievance process) would a tort claim be filed against? This is a city/donation funded nonprofit? I do not have money for a attorney at this time... so please if some one could suggest the most reasonable coarse of action Id appreciate any response- Thank you in advance.
Normally, a plaintiff sues the party who owes the plaintiff money. CR 8(a) says the following: "A pleading which sets forth a claim for relief, whether an original claim, counterclaim, cross claim, or third party claim, shall contain (1) a short and plain statement of the claim showing that the pleader is entitled to relief and (2) a demand for judgment for the relief to which the pleader deems the pleader is entitled. Relief in the alternative or of several different types may be demanded." http://www.courts.wa.gov/court_rules/?fa=court_rules.display&group=sup&set=CR&ruleid=supcr08
