How many children each of you have is irrelevant. If you own property jointly but he is retaining possession of it improperly then you will have to either negotiate a split where one of you keeps the property and one is paid for their portion, the property is sold and the proceeds split, or seek a resolution in small claims court if they refuse to cooperate.
