I was a Witness in incident about nine months ago that I hardly remember anything about and I’m subpoenaed to go to court on the 31st I have a baby and a homeschool child who has severe anxiety I have no one to watch my children and can’t make court can I get in trouble
Yes, you can get in trouble. Held in Contempt of Court. Cause the hearing to be continued.
A subpoena is an Order from the Court to be at the hearing. A subpoena can be issued by the Clerk or an attorney but either way it is a directive from the Court.
Perhaps you should contact the party issuing the subpoena to let them know what you do remember and see if you can appear by phone—which requires that you have a notary to be with you.
