And having a Professional License as a Psychotherapist, will having a recent DUI have a consequence to practicing? Can the police find out if someone drives under a suspended license with a different vehicle? Lastly, what are the typical consequences if one cant afford a lawyer, with a potential DUI BAL over .20, Thank you for your time.
Will the prior show up? Maybe. There is no way of knowing for sure but the key is making the DA prove the prior.
Will a new charge affect a professional license? Yes, most licensing boards require offenses like these to be reported upon both administrative or criminal conviction. You need to consult with an attorney who handles licensing board issues as well as a DUI attorney.
If you are contacted for any reason while operating or in physical control of a motor vehicle and your license is under revocation you will be going to jail and the penalties associated with a conviction are quite severe.
Any BAC over .200 carries mandatory jail in CO. Based on your questions, you would be a complete idiot to not have an attorney. If you cannot afford one, then apply for the public defender at your first court appearance.
The Orr Law Firm, L.L.C Is Colorado's Premier DUI and Criminal Traffic Defense Law Firm. Rhidian Orr is the senior partner and owner of the firm and focuses his practice exclusively to DUI and criminal traffic matters in the state of Colorado. His decision to answer your questions does not constitute an attorney/client relationship nor should it be considered legal advice.
If the prior was expunged or sealed it should not show. The penalties are severe and you should seek an attorney, including a public defender. Also if you are caught while driving under revocation you could extend the license revocation and face a mandatory jail sentence. Good luck.
I agree with My colleagues. If you have a pending DUI it is imperative that you retain counsel including the public defender if indigent. Do not continue driving on a DUI suspension. You are subjecting yourself to significant jail time and license revocation. If you need help with a substance abuse problem, get treatment a soon as possible as it will help show the judge you are addressing the problem. Good luck!!
