Felony charge has been expunged, no prison/jail time was served and all probation has been completed. Can a person now purchase a firearm in the state of California?
To buy a gun you have to pass California and Federal Requirments. An expungment only changes your California record, not your Federal record. Under Federal law, you likely cannot buy a gun. If California says you can, and Federal says you cannot, then you cannot.
This is a very common problem and question I get asked weekly. I even had a client who had an expungement purchase a gun, go through a CA background check, receive the gun, only to be arrested on federal charges later on. Crazy but true.
