I have just received my EAD from immigration for the first time. If my name is spelled wrong on my work permit, how do I correct that? How long will it take to correct?
You can file an I90 and ask for the fee to waived or try first calling the customer service.
Attorney Robert Brown's (former INS Director, 1972-99) reply to your question is general in nature, and does not constitute legal advice as all facts are known to him. For specific advice or representation you should retain an attorney experienced in immigration law. Mr. Brown's reply on AVVO does not create an attorney/client relationship not constitute legal advice.
You should contact the USCIS 1-800 hotline or visit the local USCIS office to inform them of the error. You may have to file the FORM I-765 to obtain a corrected version of the EAD. If the USCIS committed the error you do not have to pay the filing fee.
You need to file I-765 to replace your current EAD with wrong data. I concur that you should call USCIS and inform them the incorrect data. It might take 2-4 months to replace your current card. But you can write a letter explaining the necessity of acceleration and have it faster.
