I'm in a statement with the police officer about domestic abuse but I didn't call the police my job is because of an incident that happened on grounds. I gave a statement and now I want to recant because I don't want it to go further. I didn't realize I didn't even need to make a statement if I didn't want to. So I'm trying to figure out what happens if I recant the statement.
If you recant the statement because what you wrote therein is not true, you open yourself up to being arrested for the crime of filing a false statement, which is a class A misdemeanor. If you've never been arrested for a crime before, you are likely eligible for a program. However, in domestic cases, many times prosecutors do not like to arrest the victims of domestic crimes because it tends to deter people from reporting so there is a chance you don't get arrested at all. If, however, you just want to make a statement that you don't wish to be involved in the case or pursue the case any further, that is easy to do-- you can simply contact the victim's advocate at court who is responsible for maintaining contact with victims throughout the course of a case and state your position.
I agree with Attorney Paz with one piece of addition advice. If the police ever want to question you or speak with you again, please remember to have an attorney representing you present. It should be a rare enough thing that the protection it offers is worth it.
