I went to trial and found guilty of 2 misdemeanors and one felony drug charge in December of 2015. I served 2 months in jail and received 36 months probation. I got a letter in mail saying be in court Monday morning for the same exact case. Really confused?? This was heard in superior court and the letter says superior court this time also.
I am sure that this question is a repeat: please reask you question in the "criminal defense" section of this AVVO service
If you filed an appeal from district court, this is trial de novo and you could be tried again. Speak with your attorney about what is going on. If you don't have an attorney and cannot afford to hire an attorney, ask the court to appoint one to represent you. Best of luck!
The information provided by Attorney Matthew V. Silva is based upon the generic and ambiguous facts presented in short questions. Without a full consultation with an attorney, you should not rely upon any information presented in this forum. The intricate facts of every case are different. The information provided is not legal advice and should not be the basis of any decision without the actual guidance of an attorney. Further, any information provided by Attorney Matthew V. Silva should not be perceived as a willingness to represent you or actual representation.
It sounds like there was an appeal from district court to superior court, in which situation the case can be retried de novo ("as new"), with your right to a jury trial as well. Hopefully you have a defense lawyer retained already; if not, use Avvo's "Find a Lawyer" feature, or seek a court-appointed lawyer if you cannot afford one. Best regards.
