i received it on july 23 and it is marked issued the 25 of july. It tells me to vacate by 12 noon on august 21st i have paid last months rent already when we moved in . isn't this notice invalid because i am not getting until august 31 to vacate . Also can he make me pay aug rent and refund the last month that I already payed in 30 days after i vacate i plan on not going anywhere until i get a valid notice to quit
You keep posting multiple questions on the same situation over multiple days, many of them repeats, such as this one. The answers don't change and the bottom line for you is if you want definitive answers to your specific situation, take all your paperwork in to a local landlord-tenant attorney for a personal and comprehensive review. Generalized legal principles, repeated over and over to repetitive inquiries simply does not get you where you apparently want to go. It sounds as if the notice is likely invalid, depending upon the mailing date and normally you would have until 11:59 p.m. of the relevant date to vacate, not noon, but I do not see any basis for August 31st to be relevant. Again, the only way to know anything specific is to take it to an attorney for a personal review. This is the third time you've asked whether the notice is invalid. Based on your facts, it almost certainly is. While we can all tell you that it's invalid, we can't get your landlord or the court to do anything about it. That's why you need to talk with your own attorney.

If the notice was received on July 23, and it says you must vacate by noon on August 21, basic math shows anyone that the notice fails to give you a full 30 days. A notice that fails to give at least 30 days notice is invalid as a 30-day notice.
If you don't move out and you remain in the home, you will still have to pay for August - tenants don't get to live somewhere for free just because their landlord is kicking them out.
