Got charged with Possesion of Beer/Wine recently and i was 16 at the day when i got charged. But i turned 17 5 days after that. I heard that when you turn 17 your record gets wiped and you start a new Adult Record in the State of SC. How will that work? And i got recomended for arbitration by my arresting police officer, also i didnt get a ticket but a summons to appear in family court 2 different dates. I do have a prior conviction in the State of NC but the case has been dissmissed NOT expunged yet tho. Please explain what will happen?
You turning 17 prior to your court date does not change anything in SC. At age 16 you can be charged as an adult, and in my expereince turing 17 really only would change where you are housed if incarcerated, which you are not. If I were you I would participate in the arbitration program that is being offered, and it may be a good idea to have a lawyer help guide you through that process.
