I rented a RV Park space and the RV trailer I place in the space is not the one I put on my rental agreement does the landlord have right to evict me or refuse to renew my rental agreement?in the beganning when I rented my space I had plans to purchase a trailer which was the one I place on my rental agreement, but when I went to purchase it the owner had already sold it. I end up purchasing another RV trailer that was 3ft to big and the landlord informed me that I couldn't live in it or have it in the space I rented. 30days passed and I sold the trailer and getting another one to replace the one I sold, so now the landlord won't allow me to move in the one Im purchasing and said that I was being evicted and that she will now renew my rental agreement for the new trailer to take the place of the one I sold, what can I do? does the landlord still have to give me a 30 day eviction notice?
Yes in an RV park that is providing for month to month tenancy a 30 day notice is required. Pursuant to CA Civl Code 799.66. The management may terminate or refuse to renew the right of occupancy of a tenant for other than nonpayment of rent or other charges upon
the giving of a written notice to the tenant in the manner prescribed by Section
1162 of the Code of Civil Procedure to remove the recreational vehicle from the
park. The notice need not state the cause for termination but shall provide not
less than 30 days' notice of termination of the tenancy. But this is the general rule your rental agreement with the landlord are contractual obligations and may give you greater rights.
Review your rental agreement and if possible sit down with an attorney and review the agreement with them. There are often multiple ways to resolve issues as they arise. Good Luck!
