For the 2nd time in a year I have received a 3 day eviction notice for non payment. However, the rent was paid. My landlord insists on money orders. She is claiming she hasn't received them and now I need to come up with $3000 in 2 days. Last time this happened, I wasn't sure what to do so I paid all court fees and fines on top of the extra rent payment that she said she never received. I have a child and nowhere to go if I have to move into days. I don't understand what is going on. How can she say she didn't receive it, if I have my receipt.We haven't had any issues since last year and nothing has changed. I told her if there was ever an issue to give me a call and we would get it figured out. I live in Fl and am not sure what my rights are or what the law is regarding this. Can she continuously insist on money orders and then claim she hasn't received them?
You have a receipt that you purchased the money order, not that it was put into landlord's possession. That doesn't prove payment of rent unless your bank shows the money order was cashed by landlord. How are you getting the money orders to landlord? Why not in person of by certified mail if this has been a problem before? There is nothing anyone can do here, cancel the money orders and reissue them and pay the rent in 3 days.
