My employer is not paying me overtime pay. I have been working 48-84 hours per week for several months. Would it be better to contact an attorney or reach out to the Department of Labor? Is there more an attorney is able to do? If I contact the DOL, and they do not resolve the issue, do I still have the right to sue thru a private attorney?
I agree with Guy. The DoL routinely settles these types of cases for a fraction of what they may actually be worth. And in response to your question, if the DoL settles your case for you you are stuck with whatever they get for you.
You would probably be better served by seeking out an attorney. The Department of Labor's Wage and Hour Division is great at what it does although they are selective with the cases they can take. Also, the DOL's focus is requiring employers to comply with the law, not necessarily to get you the overtime you may be owed. Generally, you will have much more control over your case if you work with an attorney than if you take it to the DOL.
