My wife, my US born daughter and I used to live in USA.
My wife decided to go back to Iran and she left my daughter and me four years ago.
My daughter and I are in USA.
If I file ex-parte divorce now, how my assets and child custody is decided.
Do I still have to give 50% of assets and can I loose custody of my daughter?
I am permanent residence of USA.
My wife and I are citizens of Iran,
I don't know what you mean by an ex parte divorce, but the courts decide the division of assets based on many factors. Depending on these factors she could get more with less than 50%. There's more than a great likelihood that you will retain custody of your daughter considering your wife left her with you for four years and she remains in Iraq.
I think one of your biggest hurdles will be to effectuate service of the divorce complaint upon your Wife who is now in Iran. Custody will be handled separately from the divorce case. From what you have described, it seems very unlikely that you will loose custody of your child. That being said, you should sit down with an experienced divorce / custody lawyer in your jurisdiction to discuss your particular case, your options, risks and possible outcomes.
