If I file for divorce April 12, 2018 when does it expires? I have a case I had a restraining order for my husband for eight months I took it off and came back to my house for the last four months. I want to know how long is it good the filing how long it will stay open ? Thank you
Your question is difficult to answer because you have not provided many of the facts. When you say "I had a restraining order for my husband for eight months I took it off and came back to my house....." I do not know what you mean by "It took it off...". If you mean that you vacated the Restraining Order then, obviously, the Order is no longer in effect. You also say that you filed for divorce in April, 2018 (a year ago) and you want to know "....l how long is it good the filing how long it will stay open?" What you do NOT say is whether you have moved forward toward a divorce or whether you have done nothing. If you have done nothing and he has done nothing, the Court may have dismissed the matter altogether for lack of prosecution OR the divorce Complaint may just be waiting for either of you to move it ahead.
Generally speaking Orders of the Court remain in effect until that are modified/amended or dismissed and from your comments, it is impossible to determine what the Court has done over the past year.
If you reconciled and dismissed the 2018 case, you can't resurrect it. If you did not dismiss it, and you and he agreed to reconcile you may want file an amended petition with a new separation date. Otherwise, you can just go forward with the case as it is. The old restraining orders are probably no longer effective because you cohabited with him. Unless there were more recent incidents that justify a restraining order, consider dropping it. I advise you to talk to an attorney to decide what to do, because the facts you have stated are not substantial enough to give you good advice.
The court usually won't bother you much until 2 years has passed, and there is discretion to dismiss afer three years but some counties are really protective of their court calendars. Nevertheless, the Petition would be notified by mail well in advance of the court's intent to dismiss.
