Me and fiance had a altercation and he was removed from the home states picked up case and placed him on No contact order with me and his family this incident took place Dec 17 2017 but fiance was in car fire Dec 29th and court was January 25th he's currently still in ICU recovering I got notice he was in hospital through detectives but hospital called mentioned the no protection order and family had been updating me about his condition I was in question about the court hearing he won't be able to show will they continue court or reschedule a new date I'm really hoping they could do something cause I'm listed as his only contact and a bit concerned
If someone misses court, the Judge could issue a warrant for his non-appearance. If, however, the Court is aware of his hospitalization the Judge could continue the hearing. Continuing the hearing or issuing a warrant is ultimately up to the Judge. A member of your fiance's family should contact the Court and/or his attorney to let them know that he will not be appearing today as a result of his hospitalization.
His attorney should contact the court and let them know the situation so that they can get the hearing rescheduled.
It’s possible to reschedule but you really should contact the court administration or have your attorney do so. Good luck!
