If a woman lost her kids to CPS because of her husband hitting her and going to jail what does she have to do to get her kids back and can she get her kids back when something like this happens
She needs to separate herself emotionally and legally from the abuse and family violence. She needs to file a family violence protective order for herself and her children against the perpetrator, including ex parte relief on an affidavit and including a kick-out order. She needs to file a divorce including temporary orders after having him served. She retains family law counsel or goes to the public agency that does family violence protective order applications and Legal Aid for eligibility for a divorce. She seeks and gets counseling for herself and her children. She absolutely stays away physically from that man and any and all perpetrators of family violence. She provides her children a safe and suitable living environment.
