we have a tenant who occupies a residential space and two commercial spaces and has refused to sign a new lease agreement however continues to occupy the spaces and pays the rent per the previous lease. They have now stopped paying rent and we are not sure if all of the terms of the prior lease (I.e. Grace period on late rent) apply. Can we give the tenant a five day notice to vacate? Is the eviction process different for a commercial space and a residential apartment?
Since you allowed the tenant to become month to month, follow the rules for 30 day month to month eviction and head to court for non payment of rent.
