I am being harassed by my neighbors living upstairs from me and they falsely filed a ACS against me. Thankfully it was concluded as being "unfounded" but now I believe they have appealed the "unfounded" decision. And now me and my children are unable to stay in my apartment because the people upstairs are vaping very heavily that the smell and smoke goes into my apartment making it hard to breathe - and I am not a smoker. For days my 10 year old daughter had trouble with her sinuses and her face was swollen. I too fell very ill from the smoke. I tried reporting this abuse to the police but they kept telling me to go to civil court and file a complaint. But I have to still live in my apartment but am being forced out. I tried reporting it to my landlord and he doesn't want to hear it.
You should consult with a Landlord/Tenant Attorney to discuss your rights, as you may be the victim of constructive eviction and/or other remedies. Best of luck.
