My niece has lived with me and my husband for a little over a year now and we were supposed to be getting custody of her but now her grandmother who has custody of her is wanting to take her back. So do I have any legal rights to her?
No, you do not have any legal rights to the child. You can get legal rights. You can file a dependency action similar to what DHR files when a child is abused or neglected. The petition says that the child is dependent on someone other than parents/custodian for support, housing, etc. If you have had the child a year I would think you would have a good chance of gaining temporary custody.
I suggest that you contact an attorney who has experience in the Juvenile court to fully discuss. This is not something to try on your own.
