We've currently filed an Opposition to Defendant's Motion to Dismiss and have fired both of our attorneys due to their incompetence. The Defendant's are in Default and we want to know what is the next step in the legal process and what should we do?
Hire a competent attorney. Because the defendants filed a motion to dismiss, they may not actually be in default. More information is needed.
This is a general answer and is not intended to be legal advice. Any person with a legal issue, or who may have a legal issue, should contact an attorney who is licensed in the jurisdiction related to the issue for legal advice immediately.
In what way are the defendants in default??
They have responded to the complaint with a motion to dismiss...
You have opposed the motion.
the next steps are that the defendants may reply to your opposition if that is permitted by the rules of your court - or may choose not to reply....
Then the judge will either decide the motion on the papers without a hearing or have a hearing...
