Iam h4 visa holder and my wife is on h1b. Can I start a home based online selling business like selling through eBay or amazon in florida. Please explain the procedures and laws associated with it. Will it be considered illegal if I start a business in florida. Is there any legal deviation.
An H-4 visa holder may not work in the U.S. unless they hold a valid Employment Authorization Card (only issued to H-4 if the H-1B holder has an approved I-140 petition (second stage of permanent residency)). What you have described is work or employment - it is self-employment, but it is still employment - and would violate your H-4 status.
You can start and own a business or company in the U.S. However, you may not work for renumeration in the U.S. or at the business/company unless you have employment authorization (EAD) or some other type of employment-based nonimmigrant visa. Working in the U.S. without authorization would be a violation of the terms of your current H-4 status. You may have other options. Consult an immigration attorney. Good Luck!
