feb 12 - filed i539 (cos f1 to h4). f1 active at the time of filing i539 COS.
aug 12- f1terminated due to school shut down by sevis. f1 out of status
sept 12 - status still pending- initial review, contacted sevis 3 times within 6 months. no updates.
re-applied to another school to be in status.school suggested to file i539 reinstatement ( f1 extension of stay)
Question- 1) do i have to refile i539 reinstatement (extension of stay for f1) if my previous i539 (change of status from f1 to h4) is pending? if yes, then will it impact my (f1 to h4) COS application?
2) is my status legal if my f1 is terminated (from 2 weeks) and my application is pending with uscis (since 6 months)? if yes, then how long can i stay in US?
You are legal while it is pending ... you just can't go to school. Meet with an attorney to see if he/she can understand why it is taking so long.
