Husband and wife have joint ownership of car. Insurance is in both names as well. Wife is names as the primary driver. Husband has died. Does the ownership automatically become the wifes.
Yes you can. If the title owners are shown as "husband OR wife" then all you will need to do is take the title to the County Clerk's office, along with the death certificate and have the title put in your wife's name only. If it is titled as "husband AND wife" then it will need to go to Probate Court to have an order issues allowing the transfer. I have found that the County Clerk's office is very helpful with matters like these as are the Circuit Court Clerks if it needs to go to probate.
Your insurer should take the deceased off the policy upon receipt of a death certificate.
