In July of 2016, I was fired from UPS because two supervisors coordinated a story claiming I had made threats. Not being able to give a statement or asked to the validity of the accusation upper management decided to terminate my employment. In subsequent Union and arbitration hearings those two supervisors as well as other management personnel continued to defame me and insult my character, not having known me or have any extended interaction with me either at work or outside of it. Even using pictures I had posted on my Instagram account saying it was proof that I was a bad and violent person. Those pictures proving that I was a threat to people. Never once proving how correlation was proof of causation in that instance. Unfortunately I was unable to prove I didn't make any threats, and since it was the word of two management persons against one the arbitrator sided with the company. I applied for and was granted unemployment benefits. This past February UPS appealed my unemployment claim. Stating that the reason for my termination was that they were dissatisfaction with my attitude. This is a different reason than originally stated for my termination. Can I get my job back?
They used a stupid reason the second time. That is no reason for IDES to deny. Non the "Job Back" issue, Anything in an IDES case is inadmissible for any other purpose.
Before you get to a Referee Hearing, if you get that far, make sure to lawyer up.
