The company is a contract therapy. Can they take our PTO. CAN THEY REFUSE to pay severance pay IF we get hired by the company taking over the contract!
There are no quick answers to your questions. You would need to discuss many factors with a competent WI employee rights attorney to get a reliable evaluation and legal advice. My following webpage has videos with general information (NOT legal advice) about what factors generally make for a good wage or severance case: http://dvglawpartner.com/videos.
Traditionally, the Wisconsin agency that enforces wage claims (the Labor Standards Bureau of the Equal Rights Division [ERD]) interprets the law such that PTO time IS owed at termination UNLESS the employer has a policy that specifically says PTO is NOT payable at termination. However, whatever your employer's policy says, there are many issues that would have to be evaluated by an attorney before the attorney could recommend any particular course of action and weigh the potential risks and benefits of each.
