Most employees have to pay overtime, but not all do. I'm not an employment attorney, but that's who you need to talk to. Read this article, and you can search for a local employment attorney at the bottom. Best of luck! http://www.nolo.com/legal-encyclopedia/overtime-pay-rights-employee-30142.html
I agree with the other attorney who answered your question. You need to talk to an attorney who has a good deal of experience with employment law. There are a lot of factors here -- is there a union? Is there an employment contract? how many employees does Apex have? What is your job and are you considered an "exempt" employee for purposes of overtime pay? Etc. These cannot be answered on this general Q&A forum. You need an attorney who can consult with you about your specific situation and advise you what to do.
No attorney-client relationship is established with this answer. It is not to be considered legal advice, but is merely given to point you in the right direction and give you a general answer as to the law regarding the question you have asked.
