My ex husband signed the birth certificate. The real father would like to legitimize him. Paternity has been established and he pays child support. We agree on everything and just need to establish him on the birth certificate
You don't really ask a question. The biological father will need to file a petition for legitimation naming both you and your ex husband as parties. This process in made a little more complicated by the fact that your ex husband is the legal father of the child. I suggest that the bio dad contact an attorney to help him with this case.
I agree with my colleague. I’m not sure what the question here is, but if the birth father needs to file for legitimation he should consult with an attorney who can help him with the proper course of action.

The ball is in the father’s court to file a legitimation suit, get a court ordered DNA test, and obtain a court decree.
