I purchased a vehicle from an individual he assured me he had the title I borrowed money from the bank he told me the title was straight when the bank received the title it was a salvaged title. The bank was very upset because we had been lied to and the loan was given on the word that the title was not salvaged. Is there anything I can do about this legally since the previous truck owner lied to me and the bank and the bank loaned about ten grand more than they would have if he had been honest and told us it was a salvaged title
According to the facts in your question, there has been a fraudulent misrepresentation both to you and to the bank.
As a practical matter, it might be best to have the bank's attorney contact the seller and read him the riot act regarding civil liabilities and possible criminal charges.
Check with a local attorney and determine all of the options available to you. The sell has put you and the bank together in a sinking boat and you should have a unified attack.
You have to speak with an attorney to protect your interests as soon as possible. Use Avvo to locate an attorney who handles fraud and consumer cases in your area.
