I was rear ended by a county truck and we are needing a rental while we get an estimate on how much the damage will cost. Their insurance company is saying we need to go through our insurance to pay for the rental but we don't have the money for a rental right now. Since they hit us it seems like they should have to pay for everything. Please let me know the laws on this because it doesn't seem fair that they are asking us to pay out of pocket for something they caused.I forgot to add that our car that they hit doesn't have full coverage. So when we tried calling our insurance about the car they told us they can't pay for a rental so they insurance company of the truck that hit me would have to pay.
Hire a lawyer. Sovereign immunity governs these cases and adjusters and city and county lawyers will take advantage every step of the way.
I am board certified in civil trial law- it means the Florida Bar allows me to be called an expert and I have tried a substantial number of cases and undergone further training and peer review, as well as passed an additional all day exam.
Unfortunately, no insurer nor at fault driver "is required to pay for everything". One of the reasons to hire a lawyer to represent you is to make sure they pay all of what they SHOULD pay for. You should contact a personal injury lawyer immediately so you can make good financial decisions during your case.
They have to reimburse you for the rental. They don't have to front it. Ask if they will do a "direct billing..." but as you don't have collision, the rental company may charge you an ungodly amount for insurance, which you have to pay.
