my ex has an estranged family and after her death on jan 2 2018 they are pushing me aside saying i was next of kin when she was alive not in death and we are waiting to see her insurance says . do i have any claim for anything she has .
If you were legally married or in a domestic partnership (in certain instances) then you would be entitled to inherit from her estate. However, the extent of your interest would also depend on whether she had a Will and what it says. But you referred to her as your X which may change things. As to your question, you should note that if the sole asset is the proceeds of an insurance policy, the policy itself may direct to whom any payment will be made. As to other assets, unless there is a will, the legislature has enacted specific order for distribution that would first benefit a spouse or children before more distant relatives would inherit anything. I realize this may still be a difficult time, but all the more reason to meet with a local attorney in person to address your questions.
