I was assaulted by my apt. manager's son, he claims "self defense." However, all 3 witnesses (2 nghbrs. & my niece) claim he hit me first while in an verbal argument. I called the police & filed a "citizen's arrest", the person who assaulted me had no visible marks on his body (but a ripped t-shirt) to claim I assaulted him at any point. I filed a temp. restraining order which is in the process of being served. I'm wondering why the police refused to speak to ALL witnesses or physically arrested him, I was clearly bloody, bruised shaken. They spoke w/ 2 witnesses & said if DA wants to prosecute they will, it's been 2 weeks with no follow up by police or DA. Now that the police did nothing my adult witnesses do not want to get involved, I imagine they're intimidated. I have pictures, help!
A civil harassment restraining order requires "clear and convincing evidence" for the court to grant the order. http://law.onecle.com/california/civil-procedure/527.6.html. This is a high standard of proof, so you should bring all of the evidence you have. You should also consider hiring an experienced local attorney to assist you.
The police and the DA or City Attorney have no obligation to prosecute crimes, and generally are not accountable for decisions whether or not to prosecute a case.
