I don't have a driver's license(I've never applied for one) and I got caught by the police in Hawaii. I was asked to go to the traffic court a month after. I don't have money to hire an attorney. Some people suggest me to take a driving exam and get a license asap, it'd be helpful when I go on the court. But I looked up on the DMV website and it says my outstanding traffic violation has to be all cleared before getting my license. What can I do now? Thank you very much.
Driving Without A License is a criminal offense. Depending on the number of convictions, it is either a petty misdemeanor (up to 30 days in jail) or a full misdemeanor (up to 1 year in jail). Those are maximums. For a first offense, an attorney can usually work out a deal for a fine. If you cannot afford an attorney, then you should apply for a Public Defender. Traffic matters and outstanding balances must be cleared before you can get a license.
