I plead guilty to simple assault on a police officer 15 years ago. I just applied for a driving job with open door. Driving disabled adults. I got a letter from the fingerprint dep't. because of this I night beterminated. Of course I'm going to challenge it. Aren't the statute of limitations expired?
It is not a statute of limitations problem; you need an expungement and if you contact an AVVO lawyer he can help you; you can click on lawyer profile and get contact information.
No statute of limitations a criminal record never goes away unless you expunge it and even then it does not erase it from all databases.
Statute of Limitation is the time the State has to charge you. The record of a conviction has nothing to do with that. It stays on your record until or unless expunged. You are eligible for expungement right now if there are not any other impediments, like other charges. An expungement will take about 10 weeks to get an Order letting you say the event never happened, but it takes another 14 weeks at least to get an the NJ official computer entries off because of State Police backlog. The expungement will take your fingerprints and all records out of the NJ system. But your prints were likely sent to the FBI and they will not honor a NJ Order, but you can try. So even after expungement a multi-State fingerprint search may show something. Same with private sites like google. Although if worded correctly you may be able to get the private cites to take things down for a fee with the Order. Call the AVVO contributors, most offer free consultations.
Once you are convicted it's on your record but the good news is that it's been long enough that you can expunge it now unless you had more of them so you'd need to consult an attorney about whether expungement is a viable option. SOL only applies to them charging you but not expunging it after a conviction.
