A year and a half ago I was given a ticket for MIP of an alcoholic beverage. I was given a breathalyzer and registered at 0. I was holding an alcoholic beverage for a friend while they were answering their phone and excise came up right as I was handed the beverage. I tried explaining why but they didn't care. I need to know if I should say I'm guilty or if I should get a lawyer. I'm not sure what the consequences are of this charge.
I highly recommend you get an attorney to help you through this. Admittedly, this is a relatively minor offense but you could potentially avoid a conviction on your record. If you plead guilty, that will likely follow you for at least five years. Again, hire an attorney and do what's actually going to be better for you in the long run. Good luck!
I would not plead guilty to this. Typically, the court automatically enters a not guilty plea for you at your first court appearance. You can either advise the judge that you will be hiring your own attorney or you can request the assistance of a public defender provided you meet the financial qualifications to obtain one. You certainly cannot plead guilty to public intoxication if the test they administered to you was 0.00. If there is a chance to avoid a criminal conviction, which I believe you have here given what you've shared with us, I think you need to take advantage of that opportunity.
