I went on a drive around with a corperal for the sheriffs department about a month ago . I was questioned for gathering scrap metal.As we drove by one of the dwellings i had gatherd scrap metal from i asked the corperal if there would be a problem with gathering up the rest of the metal from this one particular dwelling . His reply to me was he hadnt recieved any calls about it and said if you do be careful low and behold a couple of weeks later i was arrested for what i said above.I just need to know where I stand on this. when I was arrested i did tell them the truth.
These are serious charges and you need to get an attorney to help you with this case. It sounds like you have a potential entrapment defense. Looking at all of the facts including what you have already told the police is necessary in order to give you a complete evaluation of this case. Good Luck.
There are always two sides to every story. You need an attorney to evaluate the police reports in your case and see what the officer says regarding your conversation. If an officer gave you permission to do something, and then you are later arrested for it, that may be a defense. The fact that you told the truth, and that you asked for permission should help you. Still, to be on the safe side, you need to have a lawyer evaluate your case and police report to fully advise you.
Do not speak with the police or prosecutor's office again without an attorney present.
Despite what they "knew" you were doing, only the property owner could consent to removing anything from the property. You will likely be prosecuted.
