I was very violently attacked by Loss Prevention at the Winco in Bremerton WA. I spent Christmas eve in ER with Broken ribs because i was thrown to the ground and then the loss prevention lady proceed to straddle (sit on my chest ) and put her hands around my neck and yell and cuss. Her violent temperament was shocking and i believe this company should be accountable for Mrs. Hitchcock's behavior. I was not charged with any theft because i did not have anything that was not paid for in my possession. I did go to jail for assault but i never hit or put my hands on her at all. I have talked to a public defender but i feel this company should pay for the medical bills and my work time loss for my injury.
The confrontation was likely recorded on store surveillance video, as well as their claimed justification to detain you. You should consult with a personal injury attorney in your area now, as how you resolve your criminal charges may affect civil compensation for you later.
These comments do not establish an attorney-client relationship, and are intended to assist you in deciding whether to hire a personal attorney practicing in your area and this field of law.
If you're found not guilty on the criminal charges, you might have a case for assault & battery, false arrest, false imprisonment, etc.
