YOu can incorporate in any state as long as you register as a foreign business in your home state. As to the corporate form, that should be discussed with an accountant. Good luck.
You can incorporate in whatever state you wish, but as you will be operating in MD, you will need to qualify the entity there as well, which adds to your expense. The question is, why do you want to set up in DE? You won't be doing business there, but you will need to file annual reports, pay fees and maintain a resident agent. All of which costs you money, in addition to doing much the same thing in MD. AS for whether you should be a C- corporation or an LLC, you should discuss what makes sense from a tax POV with your CPA, Certainly operating as an LLC, will likely be less complicated, but you may be running the type of business that would best be served as a corporation. AT the end of the day, you should be organizing a team of professionals to help you as you move forward. An important team member would be a business attorney.
