I have a judge that gave me a sentence. I was told to get "back on calendar" to go to court to talk about it.
If i get back on calendar for this case, will I see the same judge though? How can i see the same judge? I am not sure if i put my self on calendar i default to the sentencing judge?
You may or may not see the same judges because their assigned courtrooms change. It's not really within your control.
SAN DIEGO CRIMINAL DEFENSE ATTORNEY--20 years experience
As the previous attorney indicated you may not be before the same judge. It depends on what the judge's assignment is and why you are going before the court. Also when you pled guilty you may have signed a waiver with regards to going before the same judge that sentenced you. It is difficult to know without knowing why you are requesting to go before the court and who the sentencing judge was.
Everybody said you may or may not have the same judge BUT...IN ORDER to be safe , if you really feel that the previous judge said something about you that you need to bring up to the next hearing ASK THE MINUTES of the previous hearing
