You have not provided enough information to evaluate. Medical negligence is basically care and treatment that is below the standard of care that causes injury. You mentioned that the hospital did not follow "instructions." This can certainly be the basis of a medical negligence case. You mention that his health declined--if this was the result of the failure to follow instructions --this could be the basis of a negligence claim if the injuries were severe and/or permanent. Use the AVVO lawyer finder or google California Association for Justice to find a lawyer near you.
If you feel this is the "best" answer or is "helpful," please indicate. Since I am limited to the information you provide, I cannot guarantee the accuracy of the answer. You should seek the advise of an attorney who can explore all aspects of your question. This communication does not form an attorney client relationship.
Did the hospital deviate from accepted standards of care? Did that cause your husband injury? Need to know that before advising you responsibly.
You'll have to spell out what happened in a post, or reach out to the lawyers on here yourself. All the best to you both.
Your husband's records can be reviewed by a local malpractice lawyer to evaluate.
